Terms of use

1. Purpose

These terms govern access to and use of the TinyLink service. TinyLink lets you create pages gathering links, shorten addresses, generate QR codes and measure how they are used.

The service is free within the limits of the free plan. Paid subscriptions lift those limits and open up additional features.

2. Account

Opening an account requires a valid email address and a password. The information provided must be accurate and kept up to date.

The account is personal. You are responsible for keeping your password confidential and for actions taken from your account. In the event of unauthorised use, tell us without delay at contact@tinylink.fr.

The service is not intended for people under fifteen. Below that age, registration requires the consent of a parent or guardian.

You can invite other people into your environments and give them a role. You remain responsible for the access you grant.

3. Published content

You remain the owner of the content you publish. You grant TinyLink a non-exclusive, free licence limited to hosting, displaying and distributing that content as part of the service, for as long as it is published.

You warrant that you hold the necessary rights over what you publish, in particular over the images and trade marks you use.

The following are prohibited, without this list being exhaustive:

• violent, hateful, abusive content or content inciting discrimination;
• pornographic content, and in all cases any child sexual abuse material;
• content infringing a third party’s rights, in particular copyright, trade mark rights or image rights;
• phishing, distribution of malware and hiding a misleading destination behind a short link;
• impersonating a person or an organisation;
• gambling: casinos, betting, online poker and their intermediaries;
• content unlawful under French law.

4. Moderation and suspension

Any content can be reported to contact@tinylink.fr. Manifestly unlawful content is removed promptly after verification.

The destinations of published links are checked automatically. A link whose destination clearly breaches these terms is removed and its author informed; a doubtful link is submitted to human review. The author can contest a removal from the support in their dashboard; every contestation is examined.

In the event of a breach of these terms, the publisher may, depending on its seriousness and after informing the user where circumstances allow, remove the content, suspend the account or delete it.

A serious breach — in particular publishing child sexual abuse material, or fraud — results in immediate deletion of the account, without notice.

Deleting an account also deletes the associated pages, links, images and statistics. This cannot be undone.

5. Availability

The publisher takes reasonable steps to keep the service available, without guaranteeing uninterrupted availability.

The service may be suspended temporarily for maintenance, updates or technical necessity. Where a significant interruption is planned, users are informed.

The publisher cannot be held liable for unavailability resulting from force majeure, a failure of the host or the network, or the act of a third party.

6. Liability

Each user is solely responsible for the content they publish, the links they point to and the use they make of the service.

The publisher cannot be held liable for content published by users, nor for third-party websites reachable from published pages.

Nothing in these terms limits the publisher’s liability in the event of wilful misconduct, gross negligence or personal injury.

7. Personal data

The processing of personal data is described in the privacy policy, which forms an integral part of these terms.

8. Duration and termination

These terms apply for as long as you have an account.

You can delete your account at any time from your workspace, Account tab. Deletion ends these terms, subject to the provisions that survive by their nature, in particular liability and governing law.

The consequences of cancelling a paid subscription are described in the terms and conditions of sale.

9. Changes to these terms

These terms may be amended to reflect changes in the service or in the law. The date of the last update appears at the top of the page.

In the event of a substantial change, account holders are informed by email. Continuing to use the service after that information means acceptance.

10. Governing law and disputes

These terms are governed by French law.

In the event of a dispute, an amicable solution will be sought first, in writing at contact@tinylink.fr.

Failing agreement, and where the user is acting as a consumer, the consumer mediation provisions set out in the terms and conditions of sale apply. The French courts have jurisdiction.
